Sheer Violation of Article 10 of the Human Rights “Freedom of Expression” and Article 19 of the constitution of India; by Bal Bharti School, Ganga Ram Hospital Marg, New Delhi

Below are the brief/ the pointers (in blue) sent by the school to the parents and our comments in RED
“*Guidelines for Posting Comments on Social Media by Parents and Students*
• Although social networking sites may appear to be the quickest and easiest ways to express frustrations or concerns, it is not appropriate to do so. Other channels, such as private and confidential discussions with the school are most appropriate.Parents are continuously mailing schools regarding their concerns related to illegal fees but there is no reply by the school. The school is violating the orders passed by Delhi Education Department in this COVID period and charges fees in other heads as well (Parents mail Proof attached – Mail copy01-Mail copy03)
• Bal Bharati Public School, GRHM considers the following examples to be inappropriate uses of school social media platforms.
o Making allegations about students at the School/Cyber Bullying
o Making complaints about the School/staff at the School
o Posting negative/offensive comments about specific student/staff at the School
o Posting racist comments
o Posting comments which threaten violence
• The School will always try to deal with concerns raised by parents in a professional and appropriate manner and understands that parents may not always realize when they have used social networking sites inappropriately.NOT AGREE, firstly parents always try to get in touch with the school via phone and after that they always mail. In case of no reply, they use the next step but never cross the line.
• Therefore, as a first step, the School will usually discuss the matter with the parent and try to resolve the matter. Also ask the parent to remove the comment posted on the social networking site in question.NOT AGREE -parents have every right to express their views. Why school is forcing them to remove comments from SOCIAL MEDIA? How the school has got control upon the individual liberty of parents in using social media. 
• If the parent refuses to do so and continues to use social networking sites in a manner that the School considers inappropriate, the School will consider taking the following action:This act of school comes underViolation of Article 10 of the Human Rights “Freedom of Expression” and Articles 19 of the constitution of India. This is the kind of clear threatening
o Take legal advice and/or legal action where the information posted is defamatory in anyway or if the circumstance warrant this
o Set out the School’s concerns to parent in writing, giving parent a warning and requesting that the material in question is removed
o Contact the Police where the school feels it is required – for example, if it considers that a crime (such as harassment) has been committed; or in cases where the posting has a racial element, or is considered to be totally obscene or is threatening/violent
o Take other legal action against the individual.
• Parents must sign Parent Declaration Form , agreeing to
follow the social media policy.  – why school asking parents to fill the declaration form if the school itself involved in illegal activities and violating the laws and orders passed by the Delhi Education Department in the COVID PERIOD as well.
*Breaches of this Policy*
Any breach of this policy that may lead to a breach of confidentiality, defamation, or damage to the reputation of Bal Bharati Public School, GRHM or any illegal acts or acts that render Bal Bharati Public School, GRHM liable to third parties may result in legal action, disciplinary action in line with the published school policies for staff and students.
If parents or students are found to have breached this policy the School Principal will meet with parents to remind them of the policy. After this meeting, a decision will be made as to what further course of action has to be taken which may include legal action where there has been damage to the school, individuals or the school’s reputation.”
 
Delhi Parents Association’s Stand
  1. How the school has got control upon the individual liberty of parents in using social media. 
  2. How does the school define the independence of parents in using social media platforms like YouTube, FB, WhatsApp etc?
  3. It’s clearly a comment upon the right to privacy of parents in general, and as an individual in particular, that doesn’t entitle any institution to restrict him/her towards the use of such platforms. 
  4. Though there is always a declaration that customers of such platform electronically sign before use of the platform, and maybe subjected under various IT acts, in case of a violation. However, no such right has been conferred by the land of the law to any institution to define that. 
  5. In case of any complaints, the individual/ institution may get a fair trial under the IT act. 
  6. Any such communication by the school is not admissible as a legal submission and may call for prosecution, considering it an attempt to jeopardize the fundamental right of expression, as defined by our Constitution.
Our request to thhonorable CM and LG Delhi kindly take appropriate and legal action against the Bal Bharti School, Ganga Ram Hospital Marg, New Delhi school and also set a time-bound inquiry as the school is still violating the order passed by the Education Department regarding the TUITION FEES, as they are charging higher fees including annual and development charges.
